Nothing benefits the consumer in this bill. Sure you will be able to stay in your home at a reduced monthly payment and have your mortgage at 40 or even 50 years. Banks win on this one. If you sell after 10 years you will still owe a substantial amount of money for your loan.

The way reputable mortgage companies are handling loans right now, I would doubt it. If your credit score is at least 700, then perhaps you could get a mortgage from a lender online. However, due to the recent mortgage crisis, many of the criteria that were used in the past few years to qualify borrowers, has been thrown out the window. Lenders got burned when many bad credit people walked away from their homes and wound up in foreclosure.

There is a new FHA Express mortgage available now and you may qualify for that. 3% down and you can borrow up to 95% of the home’s value.

Bad credit borrowers are very risky and the lender doesn’t want to take a chance that you’ll default and stick them with a house they cannot unload.

My advice? Wait a couple years, clean up your credit and stuff some money away. Even $50 a month stuffed into a savings account is better than nothing. If you have a larger down payment, lenders will think that you’re less likely to default if you have a good chunk of your own money to lose, and you’ll qualify for a better interest rate. That saves you big money in the long run.

DeeDee, what does your mortgage indicate? Is there a pre-payment or other penalty? Has your homes value decreased? Do you have equity in the home.

If your home is in a declining area, your lender may require a 5 percent payment available from the equity of your home. (95 percent LTV)

I would check all your paperwork and speak to your current mortgage company. None of us know what will happen to interest rates or home values in the next 18 months.

Will I get my escrow money back from American Home Mortgage after refinancing?

I refinanced 2 weeks before American Home Mortgage declared bankruptcy. They still owe me my escrow money (a new escrow account was created at closing with the new company). Is the escrow money legally mine and protected from the company’s bankruptcy, or can the company default on paying it back? Thanks!
The AHM mortgage was paid off and my new mortgage and new escrow are already in effect with my new company. The procedure was the AHM escrow was to be refunded to us and we already have a new escrow in place. While waiting for the AHM escrow to be refunded to us, AHM declared bankruptcy. Is the escrow money legally mine? Continuing to make payments is not the issue–we are already paying mortgage payments and already set up a new escrow with the new company.
